1. PURCHASES ON THE SITE
1.1 With reference to Italian citizens, sales on the Site are reserved only for those who have reached 18 years of age. A buyer who is not an Italian citizen can purchase Products on the Site only if of legal age according to their national law. If there is no legislation in this regard, it is necessary to be at least 21 years old.
In any case, the user making purchases on the Site undertakes to indemnify Garda&Vino from any liability in the event that they have made purchases on the Site without complying with their national law regarding age limits for purchasing.
1.2 Garda&Vino reserves the right to refuse or cancel orders from (i) a user with whom it is in a legal dispute; (ii) a user who has previously violated these General Terms of Sale and/or the terms and/or conditions of a purchase contract with Garda&Vino; (iii) a user who has been involved in any type of fraud, particularly fraud related to credit card payments; (iv) users who have provided false, incomplete, or inaccurate identifying data or who have not promptly provided Garda&Vino with the requested documents in accordance with these General Terms of Sale or who have provided invalid documents; (v) users who do not provide sufficient solvency guarantees. In any case, Garda&Vino reserves the right to cancel orders related to transactions that do not exhibit an absolute degree of genuineness.
1.3 With regard to purchases on the Site, it may happen that: the purchase process contains one or more material errors; the Product Sheet, as defined below, contains incorrect information due to material errors (e.g., the price of the Product, the vintage of the Product); a Product is mistakenly indicated as available when it is not during the order preparation phase. In these cases, or similar cases, the user may request the cancellation of the order or obtain, in agreement with Garda&Vino, a different Product, possibly with an adjustment related to the purchase cost.
2. SITE REGISTRATION
2.1 The purchase of Products on the Site is allowed only to registered users.
2.2 The registration credentials must be used exclusively by the user and cannot be transferred to third parties. The user undertakes to keep them confidential and to ensure that no one else has access to them, and promptly inform Garda&Vino in case of suspected misuse and/or disclosure. The user guarantees that the personal information provided during the Site registration process is complete and truthful. The user agrees to hold Garda&Vino harmless from any damage, compensation obligation, and/or sanctions resulting from and/or in any way connected to the user's violation of the rules on Site registration or the maintenance of registration credentials.
3. PRICES and OMNIBUS DIRECTIVE (Legislative Decree no. 26 of March 7, 2023)
3.1 All Product prices are expressed in Euros (€) and are inclusive of Value Added Tax ("VAT"), unless otherwise stated. Any additional costs will be expressly and separately indicated in the order form before the user proceeds with its transmission.
3.2 The price of the Products may be changed by Garda&Vino at any time, without notice, provided that the price charged to the user will be the one published on the information sheet illustrating the main features of the Product (Product Sheet) at the time of order submission. Any subsequent price changes (increase or decrease) after order transmission will not be taken into account.
If, following widespread price reductions, such as the so-called Black Friday, Garda&Vino decides to launch a new promotion on individual products, this new promotion will take place without interruptions, always indicating the base price as the reference value for the discount (corresponding to the lowest price in the 30 days prior to the application of the first announcement of the price reduction (e.g. Black Friday).
Garda&Vino also offers personalized promotions through specific discount vouchers (coupons) for individual customers or homogeneous groups of customers, which allow them to benefit from a discount on the price of all products or specific ranges of products for continuous periods of time (including extended periods: e.g. 1 year) or for single purchases.
4. Products Section
4.1 Each Product is accompanied by a Product Sheet. The images and descriptions on the Site reproduce the characteristics of the Products as faithfully as possible. The Product images on the Product Sheet may also differ by vintage and/or dimensions or in relation to any accessory products. These images should therefore be considered indicative with usage tolerances. For the purchase contract, the description of the Product contained in the order form transmitted by the user will be valid.
4.2 All Products contain sulfites, as the wine production process itself involves the presence of sulfites in it. However, it is possible that additional sulfites may be added in the wine production process; in some cases, however, it is possible that a wine may not contain any "added" sulfites.
4.3 The purchase of gift vouchers does not affect the payment threshold, which, once exceeded, entitles the user to free shipping of the Products.
5. PRODUCT AVAILABILITY
5.1 The products offered on the Site are in limited numbers. Therefore, it may happen, also due to the possibility that multiple users purchase the same Product simultaneously, that the ordered Product is no longer available after the purchase order has been transmitted.
